What the process involves
Determining any novel and inventive features of the invention with the client. Establishing all of the advantageous aspects of such features. We then use this technical information to write up a patent application. This involves a great amount of technical detail on the invention, claims to the invention, and drawings.
This is often in an initial stage to establish a priority date and subsequently to file final patent applications such as Patent Cooperation Treaty (PCT) or European applications. Each patent application starts by discussing the initial concept of the invention, capturing the technical information in detail. Timing of filings can be critical to optimise the priority and technical detail objectives.
What the next steps involve
The Patent Office will carry out searches on the patent application to establish if it satisfies the requirements of patentability. We would then discuss with the client the best approach going forward, this usually involves putting forward technical arguments on the patent ability of the invention and possibly making amendments to the claims.
