Since the Court’s start of operations on 1 June 2023, the Court of First Instance has received a total number of 217 cases. Of these cases, 83 are infringement actions:
There has been 29 infringement actions filed, mainly in Germany.
There has been 86 Counterclaims for revocation filed with the Courts local and regional divisions. This comes from 26 individual infringement actions.
In total, the UPC Court of First Instance has received 22 applications for provisional measures, preserving evidence and orders for inspection and 21 revocation actions filed.
To date the court of appeal has received 11 appeals under RoP220.1 and 13 appeals under RoP022.2.
German is the predominant language used in the court, being 47% of the proceedings. The use of English is increasing, currently at 43% of UPC proceedings.
